Do you have to report nursing home abuse or neglect to the state before you sue the facility?

No, you do not need a right to sue letter before suing a nursing home or similar facility in California. You’re not required to report nursing home abuse or neglect to the facility or any governmental agency before you can file a law suit against them.

However, you may want to look at the agreement (if one exists) which governs the residents stay at the facility. That agreement may have important information regarding disputes that you may want to review with an attorney before filing suit.
